LEGALIZATION OF REAL ESTATE IN MONTENEGRO.One of the conditions for Montenegro’s accession to the EU is the legalization of objects. The law on legalization of real estate was adopted in 2018.
During this period, about 56,000 applications were submitted for the legalization of objects subject to legalization under the adopted law. To date, 2,818 legalization decisions have been made and six million euros have been collected through urban renewal fees. Radmila Lainovich from the Ministry of Urban Development spoke about this on the network on TVKG. However, it is worth noting that these are all objects whose construction began after the adoption of the law. Regarding properties that were built before 2018, the legalization procedure here involves submitting an application for legalization from the owner and the corresponding package of documents for the property to the state cadastre. This whole procedure costs from 300 to 600 euros per 1 object. The further legalization procedure is the responsibility of government agencies and has not yet been fully regulated. Therefore, if you purchase an object, in the list of non-possession of which “nema permissions” is indicated, you will have to complete the procedure of submitting an application for legalization to the cadastre of the relevant Municipality. If the seller, the former owner, has already submitted such an application, you must contact the cadastre and provide your contact information. This is necessary so that cadastre specialists notify you about the process of legalizing your property and making decisions on the submitted application.
